My brother on an H1B has just been laid off, he is over three years on H1B, no real chance of securing sponsorship, and has to decide fast what to do.

Mg, good luck, it looks like you may be on a hiding to nothing. The supposed 1st marriage is just hearsay, and if she left him, and never lived with him, I would guess that an annulment in this case...
