I was assuming that HMRC was giving DH the correct refund and he doesn't need to complete a self-assessment. After all, we're US residents and taxpayers. (Of course, never assume...)

Thank you for your comprehensive reply Glasgow Girl. It appears as if this is being taxed correctly and HMRC is correct to tax him. We are dual citizens, US residents since 1999.

I'm not sure what you mean by this comment. I wouldn't be 'taking a deduction' for anything. I would be paying the full amount of US taxes on our foreign pension income.

It appears you were certainly in a Catch 22 situation there. One thought... what is to stop you transferring out of the new plan? Do they also insist on an IFA...

My mum gets over 220 gbp a week in state pension. I think this is because my dad paid into SERPS (State earnings related pension scheme, replaced by the state second pension in 2002).
