Re: Grumbles about the londonIV email / premium rate info line -regards to interview

@justsomeguy, I think one issue you are missing here is that it is the U.S. Citizen who is petitioning for their spouse or fiancé to immigrate. While it is often the intending immigrant who does a...

Re: July 1st wedding & no visa yet

The bottom line is that if you told the Consul the truth you should have no problem. Working out of status in the U.S. may not make one ineligible for a K1 visa, but being caught in a lie after taking...

Re: London US Embassy

Noorah is correct. The I 130 process carried out prior to your interview was indeed administrative, and they did process your paperwork, but that was not the same 'administrative processing' that is...

Re: DCF I-864- panic question

at this point you should just relax. You have the paper that you have. Take it to your interview and let the Embasssy review it. Worst case, they don't accept it and they ask you to send in either a...

Re: Experience with getting US passport-sized photos?

There is a photo booth in the consular section in London. You do need change, I think it is 4 pounds, but may be more. That said, there is Gould pharmacy only two minutes away, and another passport...

Re: Urgent Joint Sponsor Advice Needed

Do the parents not have an income? It is often easier to qualify with income rather than assets.

Re: Unique question

Ian, I don't think the State Department publicizes all refusal rates, but Nigerian B visa (business/tourism) applicants in 2010 suffered 'only' a 33.7% refusal rate....

Re: Unique question

Ian, I'm not sure what you base your less than 50% prediction on. Are there statistics out there that tell us that 50% of Nigerian K1 applicants in London are refused? That said, I can see the Consul...

Re: Our Immigrant Visa interview at the London US embassy

You're right JEff. Some applications are just simple and clearly 'approvable.' A couple who have presented all of the paperwork correctly and whose relationship is clearly legitimate, and an...

Re: mortgage & USCIS...

We worked around this by having the mortgage in one person's name while listing both names on the title.

Re: I've been pondering this for a while...

The K1 visa is good for six months, so you can enter the US any time from the day you get your passport back until the visa expires. You then have 90 days to get married. Once married, your new...

Re: I've been pondering this for a while...

Rob, your plan won't work. The K1 visa expires after six months, and you must marry within 90 days of entering the US. On the other hand, the fact that you have a pending K1 petition does not rule...

Re: can i use vwp

Good observation Ian, but I just want to add that a Consualr Officer can indeed find a visa applicant ineligible for a previous overstay - even if no court ever ordered voluntary or expedited...

Re: can i use vwp

you may get in on VWP, if they don't ask questions and you don't admit to your previous overstay. If you want/need a C1D crew visa in the future you will have to put your time in America on the...

Re: can i use vwp

you have broken the law if you overstayed. An overstay in excess of 365 days incurs a 10 year ban on entering the US.

Re: VWP > AOS & Intent to return home

Ian, the 30/60 rule does exist in the FAM, Foreign Affairs Manual, and is applied, albeit infrequently, by Consular Officers. I am not sure what you mean by calling it a myth. Are you implying that...

Re: VWP > AOS & Intent to return home

as to the issue of intent, Consular Officers may use the 30/60 rule as outlined in the FAM. If a person enters the US with one visa category in place and acts to change that category within 30 days...

Re: K-1, illegal in UK, how to apply?

The U.S. Embassy in London does not require third country nationals to be in the UK legally to come for an interview. That said, they could very well ask questions about your status in the UK. It...

Re: Thoughts on USC spouse attending London Embassy IR1 visa interview?

Lot's of applicants bring their American spouse/fiancee along and many do not. I don't think it makes too much difference on the outcome, but it must be nice to have the support. If you're lucky,...
