I can only speak for the H1-B scenario. Your boyfriend will need to supply degree certificate(s) (and better still, transcripts) to the lawyer when he / she files the application on your behalf.

Yeah- the last published figure was 6,100 remaining as of 27th November (as far as I'm aware).
