Re: Arrested for Affray - Does he need a visa?

The question asks a little more that just arrests/convictions. The arrest/conviction needs to be one involving a CIMT. Hence the OP's problem.

One of the more knowledgable posters once said that...

Re: Affray - British Law and CIMT debate.

That might be the case under UK law but you are not trying to immigrate to the UK. For US immigration purposes I would tend to agree that Affray is leaning toward not being a CIMT - looking at...

Re: VWP or B2 ? Frequent 2 month stays to US

I'm just a little concerned by the statement "back-to-back meetings can constitute work". This would put zillions of business travelers from VWP countries in jeopardy of breaking the VWP rules. The...

Re: VWP or B2 ? Frequent 2 month stays to US

"back to back meetings can constitue work." Come on. That would prohibit most heads of state or heads of foreign companies visiting for business purposes. That's all they do, meet, generate business....

Re: Arrested - CIMT?

JCraigFong's list http://britishexpats.com/forum/showthread.php?t=559272 suggests various courts have found assault on a police office to NOT be a CIMT yet assault on a law inforcement office have...

Re: Would you transfer your £'s to A$...

Take a look at what is making the Aussie economy so strong and the British economy so weak. I don't think either are set forever. If you've been to Australia recently the cost of living it so...

Re: VISA application chances

I'll take a positive punt and say you're good to go. No crime commited, no admission of guilt. It has also been mentioned before on here that people have applied for B visa's with cautions, etc after...

Re: do i need to apply for a visa

Sounds very much like an arrest only. I'm not sure if you can be cautioned and bailed -only bailed and then cautioned. The purpose of bail is so the police can conduct further enquires whilst not...

Re: Police Certificate

I can't but I dare say that trying convince a Con Off that you had convictions without written proof could be interesting. I bet they don't often get that.

Re: B2 Visa 2nd attempt

Perhaps "visiting friends", rather than "visiting girlfriend" would have put a whole new spin on the application.

Re: Seeking a B2 visa, Arrested but charges dropped!

You can be questioned under caution which is not an arrest (no DNA, fingerprints, etc) but in this case sounds like an arrest occured before or during the interview. In some respects an arrest is...

What about the CIMT value? Is actual bodily harm a CIMT?

The following have been found by various courts and at various times NOT to be crimes involving moral turpitude:
assault, simple
assault...

Re: Consular processing and fingerprint checks

It's a big job for someone in the UK to run fingerprint checks for the benefit of a foreign government. Its not in the interest of the UK to do so.

Re: Affray conviction

I read in the 9 FAM 40.21 notes that "Riot" was NOT considered a CIMT. "Riot" being the most serious of public order offences.

Re: Affray conviction

Affray is NOT assault. Affray is putting someone of reasonable firmness in fear. Affray is a public order (or disorder) offence and can be used for anything from fighting in public to waving a...
