The European Union includes 25 countries, and Iraq is not one of them:

What's the point ? Agree that Iraq hardly is in Europe but the European
Union isn't necessarily the same as Europe.
a number of European countries are still outside the union while the union
itself is extended outside Europe (Cyprus,Spanish possessions in North
Africa,Canary Islands and a number of French overseas departments) .

But what does the EU have to do with what countries are in europe.
Switzerland would certainly be considered to be in europe by anyone but
it isn't in the EU.
With regard to the original question though. Iraq is certainly in Asia.

The judges of the european court of human rights :
http://www.echr.coe.int/BilingualDoc...EPRESEANCE.htm
include judges of azerbajian, georgia, turquey, russia, because they
are PARTLY in Europe (limited according to me to north Caucasus
(elbruz) and ural river then mountains to the east and Iceland to the
west).
IMO Cyprus is in Asia not in Europe but considered european because of
its greek population.
Armenia too because of its christian population.
Like Russia Kazakhstan is "partly" in Europe too (west of ural river).
In the ECHR lacks only for the moment the monaco, liechtenstein,
vatican, yougoslavia-montenegro, belarus and latvia judges.
Irak is in Asia.
The actual problem with the european union is must it include only the
TOTALY european countries with the exception of Cyprus because it is
an island or must it include those which are only partly in europe :
turquey, azerbajian, georgia, russia, Kazakhstan and perhaps Armenia
if the south caucasus is in fact taken in count, Turquey, Russia and
Kazakhstan being the most problematic because of their incongruous
eastern borders : Lebanon, Irak, Iran, Afghanistan, China, Mongolia,
Corea, etc...
Frankly the first solution is the more reasonable !! So it could
include Ukraine and Belarus.
