Going home for funerals without Returning Residents Visa.

Going home for funerals without Returning Residents Visa.
Haze found out on Friday that two of her grandparents died (unrelated fluke of nature.). Unfortunately, everything is a big rush, so we bought her tickets on Saturday, and she flew home today, Sunday.
We had a chat with a customs man in Aucks terminal, who told her to contact NZ house as soon as she lands to arrange her visa, also advising us that as it is a compassionate run home, they'll probably be able to sort her out, but no promises.
Anyone else had a mad panic to get the blue chit at the other end, and how did it work out?
She's in UK for a week, and has to fit in the funerals, so all is chaos.

I can't answer your question, but you could PM JAJ he's our forum expert on all matters relating to passports/visa's and may just be able to give you a swifter reply?

Please discuss on forum rather than private message, although I don't have much to add for the link above.
And it may be stating the obvious but anyone with ties outside the country needs to make sure passports, RRVs etc are up to date at all times.

Re: Going home for funerals without Returning Residents Visa.
Thanks for the replies. Looks like she'll be getting the 14 days, but that's no problem.
We were unfortunately under the impression that as we have PR, the RRV would be issued as she went out through the airport.
We had no intention of either of us going home, but both remaining grandparents on the same day forced the hand.
All I really wanted was to know if others have dealt with the staff in UK in quick time....seems not.
I'll update when Haze has been in touc h with them, others may need to know how it went.

Re: Going home for funerals without Returning Residents Visa.
I'm so sorry to read your news. There is never a good time to lose a member or members of your family. Best wishes to her at this time.
When you were issued your PR visas you would have been given your two year RRVs then. Once those had expired , then one applies for the IRRVs . It's another form and fee of course.
If her original RRV has expired, then I think all she can do is apply through the London NZIS and state what has happened. How near is she to there?
I would hope that NZIS will be compassionate and sort out a temporary RRV for when she flies back to you in NZ. It can't be the first time that something of this nature has caught a migrant on the hop nor the first time that NZIS have been asked to sort out an RRV.
Fingers crossed they make this as easy as possible under the circumstances.
Please do let us know how it goes. It could be invaluable to someone else.
Here is the link from the NZIS manual re expired RRV

Y3.50 People with expired returning resident's visa or no returning resident's visa
Immigration Regulations 1999 regs 9, 12
1. A person who is a New Zealand citizen or resident will be referred to an NZIS immigration officer on arrival in New Zealand, whether or not they appear to meet the requirements for a permit, if they:
1. travel outside New Zealand on a foreign passport; and
2. arrive back in New Zealand with an expired returning resident's visa (RRV) or no RRV.
2. If the person's foreign passport shows that they are a New Zealand citizen or have held a residence permit, the officer may :
1. give a special direction under regulation 3(7) to waive any entry requirements, if necessary; and
2. grant a residence permit, if the officer determines that:
* the person would have been eligible to be granted an RRV before their most recent arrival in New Zealand; and
* any RRV granted would still have been current on the date of their arrival in New Zealand (see X4); or
3. (if the person is not eligible for a residence permit) grant a one month temporary permit.
3. If the person's foreign passport does not show that they are a New Zealand citizen or have held a residence permit, but the person claims to be a New Zealand citizen or resident, an NZIS immigration officer must establish whether the person is in fact a New Zealand citizen or resident.
4. If the officer clearly establishes that the person is a New Zealand citizen or resident then they may permit the person entry under Y3.50(b).
5. If the officer cannot clearly establish whether the person is a New Zealand citizen or resident, but is satisfied that the person is more likely than not to be a citizen or resident, the officer may:
1. give a special direction under regulation 9 or 12 to waive any entry requirements, if necessary; and
2. grant a one month temporary permit.
6. If the officer cannot clearly establish whether the person is a New Zealand citizen or resident, and is not satisfied that the person is more likely than not to be a citizen or resident, the officer may:
1. grant a one month temporary permit, if the person meets the requirements for a temporary permit; or
2. refuse entry under section 128 of the Immigration Act 1987, if the person does not meet the requirements for a temporary permit.
7. A person who is granted a permit under Y3.50(b) or (e) must apply for an RRV at the time the permit is granted, by completing a RRV application form and paying the appropriate fee. The completed application must be sent by the officer to the appropriate NZIS onshore branch office for processing.

Re: Going home for funerals without Returning Residents Visa.
Thanks mate. I'm quietly confident she'll be sweet, but she's got so much on her mind that this is all a bit of an additional embuggerance.
IRD and NZIS are doing what they can, but that's not much over the phone.
All we can do is what we have. Sent her email copies of her Summary of Earnings, Electoral Registration and our house deeds with her name on. All she can do now is fill in form 1004 and take it all to NZ House on Friday. Fingers crossed eh?

Re: Going home for funerals without Returning Residents Visa.
.....and common sense has prevailed.
Haze was granted an indefinite RRV.
The interviewer ralked to her. looked at her passport, and that was it.
The additional paperwork was unnecessary this time around, but I think worth having as proof of status.
Big thanks to the staff of NZ house in London..
