Question Specified Adult Childcare credits transfer to wife

Hi everyone,

I currently get Child Benefit in my name as a UK national for our two children. My wife is not working and could do with the NI credits for future pension etc. Does anyone know if I can apply for this when her BRP says 'No Recourse to Public Funds' on it.

As your wife has no recourse to public funds, I'd say it's a definite no. In the link you shared is the information:

You should not apply for specified childcare credits if you are:
  • are the partner of, and live with, the Child Benefit recipient and you want to transfer the Parent’s credits from your spouse or partner to yourself – you apply to do this on form CF411A
From form CF411A Guidance Notes, one of the conditions for transfer of credits is:
  • you would have been able to register for Child Benefit if your spouse, partner or civil partner had not registered for it

If your wife is still under immigration control and has no recourse to public funds, then she is not able to register for child benefit as this is designated as public funds.
