Exclamation Returning Home to UK and complications

Has anyone who moved to USA in which to marry their partner and now after so many years considered returning back home to the UK come across any complication in bringing in their USA partner even though they have the correct visa, all due to new government restrictions here in the UK.

I know if you have considered to bring in your partner from USA to the UK to get married the UK citizen has to be earning £17.000 per year for the partner to be allowed in, only those on Disability will be excluded from this.

So just curious by both moving home to the Uk with one partner being from USA have they faced any problems even though they have the correct visa?

If you just want to bring your partner in to get married there is no financial requirement but they need a visa which allows them to marry while visiting.

If you mean you want to move back to the UK with an American Spouse, then you need to read up on the Spouse Visa rules.

Thanks for your reply Pollyana,

I would not be bringing my partner into the UK to get married, iwe would both be husband and wife, returning to the UK, but Rules are changing all the time and even though you may have the correct visa for both of you to re enter the UK, has the government set up any other restrictions?

No, as long as you earn enough money, and are not moving from a country where other restrictions apply, then everything is OK, the financial requirement may be changing, the government has been forced to look at the figures agin after a court case where a judge stated that the financial requirement was too high. All visa requests that would have been denied on financial grounds only are now on hold.

But when you sell up and leave the USA even though you have the sale of your property, when you arrive into the UK you will not have any Financial earnings as you could arrive without a job to go to.

There is a method using savings, check the requirements as I believe it's something like 2.5x the annual earnings.

The UK citizen has to be earning £18,600.

Yup... and that is pathetic.. it's caused an 'uproar' hopefully that rule will be lowered.

Read this document which gives you details of all the options open to you to make the financial requirements:

You have to qualify either through income or savings/investments. If no job to go to and no savings, some folks have returned to the UK, got a job with the necessary income, held it for 6 months and then applied for the necessary visa for their foreign spouse.
