Default Yet another EAD Question!

My fiancee entered on February 20th. We're going to get her SS card this
Friday (2/28). My understanding is that the work stamp in her passport is
valid for 90 days. Can we (or do we even have to) file for the 1-year EAD
immediately, or do we have to wait to get married and send the form in with
the AOS petition? Am I correct about the work stamp being valid for 90
days?

I know it takes a while to get an EAD card, so I want to stay on top of this
without her eligibility expiring. Thanks for any advice.

Hi,

The work stamp in her passport is valid for 90 days, however it is difficult to find an employer who will hire you without a SS number.
It took us about a month to get Rajat's SS number (he applied the day after he arrived). When you go to the SS office on Friday, you will probably find that your fiance is "not in the system"... so make sure to check back with them frequently. If her information has not been entered into the system by the INS then you can request the SSA send down a G-845 form to their office which will verify the info they need to assign the number.

You cannot apply for the 1 year EAD until you get married and send it in your Adjustment of Status petition.

If there is a gap between your 90 day EAD and 1 year EAD then technically you are supposed to stop working. So, the best thing to do is do your civil ceremony and apply for your AOS soon after!

Good Luck,

Rajat & Sharmila
