Wife received EAD with wrong DOB, can she still work?

Default Wife received EAD with wrong DOB, can she still work?

My wife and I have been married for over a year and have our I-485 in
process (its approved, but its a 3 year wait or something?) We applied
and were denied her first I-765 EAD because of her status number was
incorrect. I refiled the next time online and accidentally put in the
wrong DOB. They told me I couldn't cancel the application but they'd
fix the information on the phone. So they said it was fixed. Received
the acceptance letter and waited 3 months and then found out they didnt
have her finger print. Finally got the finger print and now a week
later, we received her card after a year of this application.

Now the REAL problem - the card has the wrong DOB on it. Of course I
don't have documentation that the woman at the USCIS corrected the
information in their computers since it happened on the phone. After a
pleasant call with their CSR, I was told we had to mail her card back
to have it fixed with the application fee. I asked if she could still
work in the meantime because we've been waiting so long. She said she
had to transfer me to someone else and I was hung up on (after waiting
for 30 minutes to get through, and at the end of the day so I couldn't
call back).

So can she work although her DOB is incorrect? We have to renew by
March anyways (its August now and we just got this stupid card and it
expires in March). Also, I've read things on this forum about people
saying they need a SSN, too, but I thought we can't get that until she
gets her permanent residency which is like another 2 years. Help me
please before I go absolutely nuts.

Yes, your wife can work on her EAD with the incorrect DOB. If I were you, I'd let it go until you apply for a renewal EAD (which it sounds like you might).

However, I was confused about something. You said her I-485 was approved, but there is a 3 year wait for something? You mean her AOS interview? If you are still waiting for her AOS interview, then the I-485 is not approved, it's only received.

Your wife can go apply for the SSN now, by showing her EAD. You don't have to wait for her Green Card.

You should come around the forum more often, seems like you need a little guidance in the process. For example, having biometrics done is part of the process, but seems that you left that part out until they reminded you somehow.

I am sorry to hear the first EAD was denied, I didn't know it could be denied due a wrong date of birth!, that is a bummer
When you say your AOS was approved but you have to wait 3 years, what do you mean exaxtly?
I know how you feel about the expiration of the EAD.. I applied in April.. got it approved 6 months and a half later.. luckily the EAD was good for 2 years since I was a K3.

Rene, thanks! I am totally misguided as the governement has been ZERO
help during this whole process. The first EAD was denied because of the
wrong status code. She's a C9, and we put something else that one of
their CSR on the phone said we should after discussing her status with
her.

We have not had an AOS interview (what is that by the way? the thing
you see in the movies? we were wondering when they'd ever ask us to do
that. how long does that usually take for them to ask us?)

I was under the assumption after reading through the USCIS website that
she would get her SSN after getting her permanent residency. Am I wrong
about this? Does she have to have a SSN before she can work? Did I
mention I hate our immigration department? They have made this the most
hellish experience I've ever had to deal with. Everytime I call them I
want to ask for their manager to complain about their service but I am
constantly reminded that I the manager is the president. It's not like
I can ask for a meeting with him.

Thanks for listening and helping with all of this. I'm just a bit
frustrated right now with everything especially after this last
telephone call. Any help would be appreciated. I was originally told by
the city when they married us that we didn't have to do anything and
that the government would contact us. Grr. Anyways, more help please!

But when she shows her EAD it will have an incorrect DOB that won't correspond with the information that the SS office have on her. Will they issue a SSN in those circumstances?

OK, your AOS interview is the interview where she will be approved or denied her green card. I don't know when yours will be, since processing times are different for each local office. But, with an I-485 in the works, eventually it will lead to an AOS interview. AOS = Adjustment of Status.

As for her SSN, she can get it before she gets the green card, yes. She can get it by showing her EAD, which currently has the wrong DOB. I don't know if they'll accept that or not...best thing to do is go into SS office and show them all the documents, explain the problem, and ask them if they can issue her SSN based on this information. If they say yes, great...go for it. If they say no because of the wrong date, looks like you'll have to work on getting another EAD with the correct date.

That's the way I see it, anyway.

Oh, and yes, she needs her SSN before she can work. And, if you are calling the 800 misinformation line, don't even try getting a real answer from that source. Not only are the people who answer the phone there contract workers and know squat about immigration rules...they probably know even less about social security issues.
