What Do We Do Now?
Hello.
Here's the scenario we need help with....
We've been dating for 5 years.... I visted him in his country mostly
but 2 years into the relationship, he was blessed to obtain a working
visa to come to the states and has been doing so for the past 3 years
(seasonal).
But then that stopped and I went back to visiting him in his country.
So now we decide that yes we can't stand not being in the same space a
lil older a little wiser so we get all the info to file for the k-1
and put together a package for filing.
And soon as I visit him to get his signature and the rest of the
documentation he says... guess what? The job in the states called me
back for another seasonal stint... well I say we need to wait on this
K-1 let me think what to do.. so here I am I'm stuck stuck stuck!
Should we (still) file the k-1 when he arrives in December (we'll be
in different states) or should we (is it wise to) take the plunge here
- get married in the 6-7 months he's here and file for adjusted
status.
If we do file the k-1 in the states which means the paper work has to
be revised a bit... whats the chances of him staying here while the
decision is being made? And... more importantly keeping his working
permit... will we have to refile all over again when we move from the
state of his job to the state where he will reside, can he travel from
state to state w/o penalty.

Moving around while doing the processing can be done, but it's easier if you don't have to, but it's form AR 11 I believe, and you should inform ucis centre that is processing the stuff, and the new one which you will be nearest.
You'll definately get better information tomorrow (monday), because it's a bit quiet on sundays, sorry I can't help much more.

Hey Bob! Thanks for replying!! With these hurricane's going back and
forth and other things..its been a busy month for both of us. I will
look into the K-3 and see if its for us. I got some info from another
site but this was the best advice yet. Him going back home for the
interview when he's already here seems a bit much. Thanks again....
I had other responses attached to my message that didn't belong to my
questions. Do you know how that happened? Did I do something wrong.

If he stays beyond the expiration of his temporary status he must apply to
change to another status like B-2, or violate status.
You could marry and file Forms I-130 and I-485 (for adjustment of status) at
the USCIS district office where you will be living permanently. These could
be filed, together with an I-765 to get an EAD (employment authorization)
and I-131 to get advance parole (travel permission), right before the end of
the temporary status. Then there would be no change of address involved.
You could wait for several months after his entry in the temporary status
before marrying or taking any formal steps toward marriage, so he won't get
accused of preconceived immigrant intent.
As soon as the I-485 is filed, his status in the U.S. is authorized. The
EAD will take a little time, depending on the district office usual
processing times, but no more than 3 months.
And... more importantly keeping his working
