Default VWP marriages???

Hi everyone,

Im new to this forum so please bare with me. I was wondering about VWP marriages. My husband and I got married on the VWP, I have looked around and asked for advice and the only thing I get back from people is that, if he doesnt go home before his 90 days is up he will be deported and not allowed back into the US for 5-10 years!! Is this true?? He is seriously thinking about going back to the UK, tho I dont want him to. Neither one of us knows what to do or what papers to file or even fill out. The only thing I know is I am suppose to file a l-130 but other then that I do not know. would anyone that got married on a VWP be willing to share their stories and expericence with me. I'd love to read about them and know what things to expect and if it was a smooth or difficult.

I have also read about affidavit of Support, since I dont meet the 125% poverty line or even the 100% line will I still need a co sponsor for my husband. I am employed but have only been employed for a few months. would anyone please tell me if I need a co sponsor??

I would also be very greatful for anyone willing to tell me step by step on what needs to be done and what forms need to be filled out and filed?

Hi:

There are two types of situations where this question comes up -- one is "can I come here while the K-1 is pending?" or "can I come here on the vwp in order to get married?"

The other one -- and this is what YOUR situation seems to be -- I'm HERE on a vwp and I just got married. That is a different situation and the law allows it.

I want to make CRYSTAL CLEAR that I do NOT recommend entering on a vwp in order to get married.

I married and adjusted status while on the VWP. It was time consuming but not difficult.

You file the I-130 application for alien relative. At the same time he submits an I-485 application to adjust status to permanent resident. You will need an I-864 with co-sponsor for the affadavit of support. Remember that later on, when you get an interview many months from now, you can bring a revised I-864 if, at that time, you will meet the 125% guideline.

You will also be asked for various supporting forms: eg. G-32 5 - biographic forms in many copies, possibly the EAD application (so he can work while the years pass in the application process) and maybe an advance parole application (Should he want to leave the US before getting green card status.

It does not really matter if he is out of status (over 90 days) and he should not leave the US unless he wants to go through a lengthy separation for a spousal visa to return
