Visitor Visa, Marriage, Divorce, and reMarriage question...
I came here on a 6 month visitor visa. Close to the end of the 6
month period, I got married to a US citizen. We filed all the needed
paperwork (I-130, etc.) and had an interview that went very well, but
my temporary status was never approved. My husband and I are very
independent people and have little documentation of a shared
relationship (a few pictures, and one year of shared taxes, is about
all.). I met someone else that I'm truely in-love with and want to
marry him. We are in the process of a divorce and he has withdrawn
the petition for me and claimed our marriage was a fraud. What are my
options?
I think I'll have to go before a judge and be placed in deportation
proceedings. Will they detain me? I really want to stay in the US
and re-marry. If I'm placed in removal proceedings, can I live here
illegally and adjust status with my new husband? Anyone have any
ideas or thoughts?
If I go home, how long will I have to stay before I can come back?

So you were not in love with your first USC husband?
You are here legally in the country and free to divorce, that's a good
thing!
You now want to re-marry and apply for another AOS process again, that could
be a bad thing because it more or less proves that your first marriage was a
fraud.

Can someone just answer my questions?
I do have a lawyer and I'm working on things, but I was wondering what
are my chances and what are my options? If I get in deportation
proceeding and don't go home - does that prevent me from adjusting
later on, or will they forgive that like they forgive overstaying a
visa? If I go home, can I file a new visa to come back and marry
again and how long would that take?

Your attorney knows more about your case than people in the newsgroup do, and he also knows more about the law than most people in the newsgroup do.

You are here legally in the country and free to divorce, that's a goodthing!You now want to re-marry and apply for another AOS process again, that couldbe a bad thing because it more or less proves that your first marriage was afraud.
