Visit Visa vs. K-1 Visa

Default Visit Visa vs. K-1 Visa

I have some questions regarding visit visa and k-1 fiancee visa. my fiancee
lives in philippines and i want to use the easier way to bring her here to
new york. i have heard it is not easy to get a visa in philippines.

would it be easier to bring her here on tourist/visit visa and marry her.
after marraige, i could apply to have her stay extended, then apply to get
her status adjusted to conditional perm residentency, and after two years
apply to her status adjusted to perm resident. we want to get married in
good faith and i understand immigation will check that.

isn't that easier than going thru the hassle with k-1 visa? please advise.

it is illegal to bring her over on a tourist visa...chances are likely that she would get stopped at the airport on her way into the US and turned back around again....

i found that out the hard way b/c i didn't do much checking into this before my fiance tried to do that...

i would suggest going for the K-1. if you bring her in on the tourist visa and she does make it past the POE, you get married...you could run into problems when you try to adjust her status later...and she could be deported for fraud since your intent in applying for the tourist visa was to get married

Dq,

A B2 tourist visa is intended to allow for a person to visit the US for a limited period of time, no more than 6 months, and then leave the US.

A K1 fiance(e) visa is intended to allow a person to visit the US for a period of 90 days and get married, with the expectation that after marriage they will apply to adjust status to Permanent Resident and remain in the US.

The easiest and least hassle way of doing things is to use the visa that suits your purpose.

Just one thing to note re. the B2 visa; the applicant must prove notable ties to their homeland and also that they have sufficient income to cover their stay in the US.
I've heard that it's not the easiest visa to obtain.

IMHO I think it would be advisable to take the K1 route and do it by the book.
As you're in NY, I think you'd be going through VSC which is one of the speedier centres usually, though it does go through slumps every now and then from what I've read, (but not experienced).
Whichever way you decide, it's gonna take time to be processed.

Yeah sure...

...and some people consider that it's easier and less hassle to obtain money by robbing a bank, rather than working. But hey, that's illegal too!
