Unemployed while 485 is pending
Hello All,
What would happen if one gets unemployed while the employment-based 485
is still pending?
Will it be possible to renew the Advance Parole "AP" and the Employment
Authorization Document "EAD"?

When the final processing is done, they will ask you to provide a letter from
your employer. No employer, no green card. Better get a similar job quick
enough...

When the final processing is done, they will ask you to provide a letter from
your employer. No employer, no green card. Better get a similar job quick
enough...

If I join a graduate student through an assistantship i.e. 50% research
assistant and 50% student. Would that solve the problem of being unemployed?

Nope. That will not work. A GRA or GTA is not a "job". The job has to be
permanent, such as the one you had when you filed the I-485.

Nope. That will not work. A GRA or GTA is not a "job". The job has to be

How about switching to Consular Processing? Is there any difference?
Will I have provide an employment letter also?

How about switching to Consular Processing? Is there any difference?
Will I have provide an employment letter also?

CP is in general much faster, usually takes 4-6 months or so.
But if you have an I-485 pending, you'd have to file an I-824 to switch
to CP, and that also takes quite some time.
Then there is a somewhat informal procedure called AC140 (basically
sending an attorney-certified copy of the I-140 application and the approval
notice to the consulate), but it is in the discretion of the consulate
to accept it nor not.

How about a part-time job, is it OK to be a part-time employee to get
the I-485 approved?
