Travel to USA after K1 issued, but not on K1 visa
Hey guys,
Happy Holidays.
I've been wondering, with the 6 month period to go to the states from the date of issue of the K1, is it still possible to go to USA on the WVP even through you have a K1 visa, just to final a few things before you move over for good.
I assume that customs officials will be able to see you have a K1 visa when you pass through POE, and what the stance was on not using it at that time?

I travelled to the US after acquiring a K-1 (in 2002) without invoking
it. I took advantage of the fact that as a Canadian citizen, I only
needed to show my Canadian citizenship card instead of a passport to
gain entry. I was ready to explain my situation (was visiting to make
wedding plans a month before actually using my K-1) had the POE officer
questioned my reason for entry. He asked me verbally if I am Canadian
and let me enter :)

Pakistani, Canadian and US citizenship.

If you're using the same passport the K1 is in, odds are VERY low (IMHO)
that they will let you go without triggering the K1.

I can't trigger the K1 if I don't have it with me, or a completed I94 can I?
If I just fill in the normal forms for Visa Waiver Program, will this not suffice?

Ah ok, I was under the assumption it was a seperate document, not something that was inserted into my passport. With that being the case, I guess it'll be pretty much impossible to travel with it and not use it.

Yes, it actually seems that it gets laminated to a page in your passport (perhaps to decrease the liklihood of someone losing it) and it quite permanent. After you land at the POE they will draw a line through it, mark it with the date you entered and the officer will initial it.
I suppose if you had a passport from another country (due to dual citizenship) you could use that. Maybe someone else has experience of travelling but not activating the K-1, but as I said, I'd find it unlikely.
