Hi - New to this group. Real quick --- entered with B1/B2 visa along with 2 children.
Married citizen and divorced within the year due to hardship in the marriage, yet not
abuse as such. Even though an interview took place, no status had been approved, and
so we are therefore illegal. This all took place in 1999 and I have not heard from
INS since my petition was withdrawn. I now wish to remarry - will a second marriage's
petitioning be successful? My eldest daughter is 17 - can she be petitioned due to
this second marriage if it takes place after her 18th birthday?

No, you need to marry PRIOR to her 18th birthday. See this link from the INS: http:/-
/www.ins.usdoj.gov/cgi-bin/folioisa.dll/lawbooks.nfo/query=[jump!3A!27act101b1!27]/d-
oc/{@699}/hits_only? In order for your US husband to petition for the child on an
immediately-approvable basis, you must marry before the 18th birthday.

You should be able to do this, however, I know of no contraindications in the law to
your doing so. (eg, after second marriage)
