Stupid question time.

Filed for removal of conditions back in April of this year with Nebraska. Had paperwork, pics and $205 cheque sent back with a letter stating an error had been made when I received my greencard back in July 2004. At that time I should have received a 10 year card and not a 2 year card based on my anniversary date and date of approval for residency (it was 6 days after my 2nd anniversary). I was to take the letter (from Nebraska) and have my local immigration office review my case, correction would be made. So I did that. I had to fill out an I-90 and send back my card as well as my son's back to Nebraska (to get the cards changed to 10 year cards). I received receipt in the mail from Nebraska a few weeks ago.

Expiry on our 2 year cards is this Friday and no cards back from Nebraska. What is the next course of action?

Hi,

It can take up to a year or so for the new cards to come in the mail. In the meantime, if you need to travel, you can make an Infopass appointment to go in person and get the I-551 stamp in your passport. Bring all your relevant paperwork with you to prove your status.

One last question. There are no plans to travel outside of the country for quite awhile. I am however trying to obtain employment. Currently I have only copies of my greencard and my son's. If I were to obtain employment would the expiry date showing of July 7, 2006 create a problem to a potential employer?

Our local office doesn't deal with the stamps. Son and I would have to get passport photos taken and then our local office would issue us temporary cards.

I know, it's probably best just to go to the office by week's end and get temporary cards.

I wouldn't think it should be a problem. Your card expires, but your PR status does not. You are work authorized as a PR.

Unfortunately, you cannot show a copy of a document for proof of
employment eligibility, only an original will do.

However, if you have a SS card with no retrictions on it, you can use
that along with a valid official photo ID, e.g. a driver's license (see
I-9 form requirements).

Otherwise, you have to go get the I-551 stamp in your passport which is
good for a year.

Note that the I-551 stamp is subject to reverification, i.e. if after
it expires you still don't have your green card in hand, you might have
to go renew it to continue to be eligible for employment, even if it is
the same employer.

The physical cards (both the 10-year and teh 2-year conditional) are
not subject to reverification even though they expire, i.e. once you
should them to establidh proof of eligibility, your employer cannot ask
you again for proof even if the card expiration date has passed.

Thanks for this information. I'll head down and get that temporary card just to play it safe.
