Default Recently married - question about filing & need for a lawyer

Hello everyone,

Our situation is US citizen(me) has married a Japanese woman who has been in
the US on a student visa in June. We did not file immediately, we had a trip
to Japan planned for fall and were unsure of the whole advance parole thing,
besides we weren't ready with the paperwork. I returned to the US last week.
She is coming back next week now on a tourist visa.

Our thought is for her to go back again and file from Japan in January,
rather than here in the US.
Any thoughts? Caveats?
