Default Question about Advanced Parole....

My husband will be applying in June to have his conditions removed
(during his 90 day period), .. if he wants to fly over to the UK
before then does he need to have advanced parole? we thought that was
only needed while his A.O.S. was pending (which he was already
approved for).

No. He does not need advance parole. He is already a LAPR. The condition does not affect that while a timely I-751 is pending.

Hi:

Sorry, I should avoid jargon -- its is immigrationspeak for "Lawfully Admitted for Permanent Resident." Government people will refer to "lappers" when talking about people with "green cards."

Another acroym is "EWI" for "Entry Without Inspection" -- so instead of the derogatory and incredibly non-PC "wetback" or "wets" -- the government people will say "ee-wee". [BTW, a variation is "pollo" which is Spanish for "chicken" -- they are the customers of the professional smugglers aka "coyotes."]

To give you more info. He will get back a NOA from the I-751 application
that allows him to travel (and work) for a further year. Some local INS
offices will give a temporary stamp in the passport too but most say
(rightfully) that the NOA is good enough. He should file as close to the
beginning of the 90 days to make sure he gets that NOA in time.

Andy.

thanks for the reply...we know another US~UK couple living in another
state who told us the UK spouse had flown back to the UK for 11 days
and had to use Advanced Parole to do so..they have been married almost
1 year, applied for his AOS. but had no interview yet., could that be
why Advanced Parole was needed in their case?

Yup. Pending PRs need AP, PRs don't.
