Default Please I need help

I am in a difficult situation .
I am alone in this country .My husband mentaly abuse me .
I don't work .I am not able to support myself .
We got married 3 month ago with papers .He is an american citizen .
I apply for Social Security Number and for green card .I have't
received the papers yet .I am waiting for them .
He starts the divorce . I can't pay an attorny .
What I should do ?I am almost on the street .
I am afraid to go home I don't know at what to expect ,if I will be
able to
call somebody ( even police ) .
Can he withdraw my papers from INS ? Or his attorny ?
How can I stay legally in this country ?
Should I announce INS ? Can they help ?

Look for a woman's shelter for victims of abuse in your city. You may be
able to stay there a while and people there may be able to answer your
questions or give you good advice, and emotional support.

Definately contact the shelter and get off the street. You will be unable to
work, so if you don't sort this out you will have to leave.

The marriage would come under review even if you did not divorce, so the
fact that you are divorcing makes the marriage in terms of the INS null,
meaning that according to INS rules your application for a green card should
be denied.

Contact the INS immediately for advice.

I would concur with the other posters about seeking assistance with a victims' shelter. Beyond this, did you apply for an employment authorization card with your green card application? If so, did you receive one yet? With employment authorization, you can legally work before you get a social security number, if a potential employer allows it. Also, a divorce doesn't exclude you from getting a green card. But, the path is difficult without money. You will need to show that you can support yourself financially, or else find another sponsor. You also may be asked to provide evidence that your marriage was entered into under good faith. Best wishes,

It is a shame to hear this kind of stories when husband abuses their wives. I have read something about abused spouses, the INS has a protection for them, and even if they got divorced, they don't lose their green card or may be in your case the INS may grant you a GC since it is not your fault of the divorce. And by the way, the divorce takes months. You can call the INS customer service, I will post the phone number; ask about abused spouses that are already filled for GC and what they need to do or forms to send. Also, your spouse had sign a paper of support for you, he has to in order for you apply for GC, so, either way, he has to support you by law, also, you can check for lawyers that can help you for free"government lawyers" or you can setup an appointment with a lawyer for free consultation, lots of them offer the consultation for free. Good luck. and by the way, all it takes is a phone call to 911 if your husband is sick and is abusing you badly. Ihope something will work for you.

At long last, the U.S. Immigration and Naturalization Service (INS) has issued regulations permitting certain abused spouses and children of U.S. citizens and permanent residents to "self-petition" for green cards under the Violence Against Women Act (VAWA). The Act was enacted as part of the Violent Crime Control and Law Enforcement Act of 1994. Spouses and children who have been battered or subjected to extreme cruelty by a citizen or resident of the U.S . no longer have to depend on that person to obtain green cards.
The Violence Against Women Act
Although the Act uses the word "women" in its title, it applies equally to men and women.
VAWA allows a spouse or child to self-petition either as an (1) immediate relative or under the (2) family-based 2A category if they are persons of good moral character and if the following two requirements are met:


The marriage was entered into in good faith, and the alien or a child of the alien has been battered or subjected to extreme cruelty during the marriage; and

Deportation would result in "extreme hardship" to the spouse or the child.
The INS Regulations
The INS issued interim final regulations on March 26, 1996 which provide that the self-petitioning spouse or child must:

Be residing in the U.S. when the application is submitted to INS;

Be eligible for the immigrant classification sought;

Have previously resided in the U.S. with the citizen/resident;

Have been battered/subjected to extreme cruelty by the citizen/resident during the marriage or be the parent of a child who has been battered/subjected to extreme cruelty by the citizen/resident;

Be a person of good moral character;

Be a person whose deportation would result in extreme hardship to him or herself, or to his or her child; and

Have entered into the marriage in good faith.
In addition, the self-petitioning spouse must be married to the abuser when the petition is filed. However, the termination of the marriage through annulment, divorce or death after the petition is filed will not prevent the petition from being approved.

If the self-petitioning spouse remarries before becoming a lawful permanent resident, he or she loses eligibility to immigrate based on the self-petition. In such cases, the new spouse, if he or she is a U.S. citizen/resident may petition the abused spouse.

Procedure and Evidence
An abused spouse or child of a lawful permanent resident may submit a visa petition (form I-360) at the INS Service Center having jurisdiction over the matter. An abused spouse of child of a U.S. citizen may submit an application for adjustment of status (form I-485) currently with a visa petition at the office having jurisdiction over the spouse's/child's place of residence. Self-petitions may not be submitted abroad.
"Extreme cruelty" may include being the victim of any act, or threatened act , of violence. Acts of violence may include any of the following:


Any forceful detention that results, or threatens to result, in physical or mental injury;

Psychological or sexual abuse or exploitation, including rape, molestation, incest (if the victim is a minor) or forced prostitution;

Acts that may not initially appear violent but are part of an overall pattern of

Under the Violence Against Women Act (VAWA) passed by Congress in 1994, the spouses and children of United States citizens or lawful permanent residents (LPR) may self-petition to obtain lawful permanent residency. The immigration provisions of VAWA allow certain battered immigrants to file for immigration relief without the abuser's assistance or knowledge, in order to seek safety and independence from the abuser. Victims of domestic violence should know that help is available to them through the National Domestic Violence Hotline on 1-800-799-7233 or 1-800-787-3224 [TDD] for information about shelters, mental health care, legal advice and other types of assistance, including information about self-petitioning for immigration status

Not to appear too hard here, but how do you know that this person
didn't marry an American expressly for thsi purpose and he figured it
out sooner rather than later.

That may be the case, but it is no excuse to beat her up. Apparently, he is
not being very gentlemanly about it. IMHO, a simple divorce should have
sufficed.

not that i am condoning anything that has/may have been done, but the
original post mentioned nothing of physical abuse, only mental/psychological
abuse. none of us know the facts behind this and have only heard a very
condensed version of one side of the story. i wholeheartedly agree that the
young lady should follow the advise posted and seek out the help offered,
but do not feel that we should automatically condemn someone when we know
nothing of what has happened.

just my humble opinion to add to the others.
