The only source to use for legal advice is a reputable immigration attorney. Not a visa agency.

Processing might be longer than you expected, but you can still visit each other during that time. It will pass quickly.

Up until recently, total processing time was about 8 to 10 months (still longer than what you were told). Now things have slowed down, adding an extra few months. There's nothing to be done about it, and maybe things will speed up again. All you can do is choose a path, start the process, and enjoy the ride!

Thank you so much for your help. I guess there’s no point just sitting here moaning and moping about it lol we just need to fry going on it!

Do not use a visa agency. Use either this forum or an attorney (The former will likely give you better information).

My advice is to come over here, do a courthouse wedding to make it legal (Don't necessarily tell the immigration officer this) - Just come here 'on vacation' so to speak.

Return home, file the paperwork and wait. You can still visit whilst your petition is in progress. Your fiance must earn over the amount for his household (So if it's just the two of you he must be over 20k if I remember).

Use the time in between getting married and moving to put your affairs in order, it goes quickly.

In regards to time frame, my wife and I filed last January and haven't even reached the NVC stage and at this rate could be another 6 months plus. :(

Yeah, agreed. Your senator or state rep should be able to sort that in 48 hours, that is awful!

The OP has a mightily confusing situation with regards filing the I-130...... hence the delay.

Absolutely not a normal case, its been one whole year today since we filed the I-130 I'm hoping and praying for some news soon. :(

Hi all thank you for your input. Myself and my OH have had a long conversation and have planned for the long delay so we are going go use this time to save and get everything organised then we will go down the k-1 route which I know I said about working right away but we can afford for me to wait 100 days if needs be so I’ll use that time to explore my new home :) also we are going to file the initial paperwork this weekend :) will update as we go along in case anyone else wants to follow the progress for their own knowledge. Oh and we won’t be using a visa company now just our brains and yours too lol!

Good luck. The best route is the one that works for you two.

Hi all,

Just a quick update. We put our papers in almost 2 weeks ago and we just got the NOA1 yesterday - waiting for our I-797 to arrive in the mail now. I guess now is the longest wait until we hear anymore.
