more evidence for I-751

Default more evidence for I-751

Hi all,

I have some questions I hope somebody could help me with.

I am married to a US citizen and we've been married for the last two
and a half years, but we've been together for more than 9.

I have a conditional residence since March 2003 and I sent an I-751 on
March to remove the conditions.
Yesterday I got a reply saying they need "additional evidence" (Notice
of action I-797)

I am not sure what to do because I already sent multiple copies of
everything required including joint account statements, joint apartment
rent leases, utilities, medical insurance together, credit card bills,
checks, sworn affidavits, joint taxed, etc.
The only things I didn't send from the list were the ones that don't
apply like birth certificates, or joint mortgage, etc.

I called today the USCIS and they told me that maybe they just lost the
documentation, or transfer the case to another officer that didn't have
it, but couldn't tell me exactly what is that they need.(I wonder if
this really happens, that they just lose the applications)

1_Should I re-send all the information as USCIS told me? (The letter
says I should only send additional information, but the woman told me I
should re-send all)
2_What if this is not enough? Could the petition be denied? I read that
sometimes they interview the couple. Will I be interviewed then or
denied? What's the normal procedure?
3_The letter I got (I-757) also mentions "photos" as evidence and I
didn't see that in the I-751. Is it possible that's what they want?
4_Should I start looking for a lawyer before doing anything? I am
afraid my petition could be denied even though my marriage is good and
I will have to start all over again.

I'm curious... why would you think that a joint mortgage doesn't apply? At any rate...

1) Yes.
2a) They will send another notice; b/c) I doubt it; d) There is no normal procedure.
3) Yes, it's possible.
4) No.

Think "comingled assets" so if you want to include additional evidence not sent originally, send:

any money/financial related items in both names. e.g. insurance policies, your mortgage, brokerage account statements, 401K (or equivalent) documentation, retirement plan documentation, etc.

Suggest you look for posts from "Manc" in the last three months. He had exactly the same situation and you can read our response to him. He was approved once he sent what we suggested.

Hi:

There are three permissible responses to an RFE:

1. Give them everything they want;
2. Give them part of what they request and make a ruling on what they have; or
3. Provide nothing and request what they go forward on what they have already.

The only thing you can NOT do is ignore the RFE. That is the one thing that results in a certain denial.

When I get RFE's from Hell like that, I tend to tell them "As per your request, attached please find an additional copy of XYZ" and so on down the line
