Read the last two posts very carefully. Ian and SD make some good points. Before you look for immigration advice, take some life advice. 8 - 10 months is absolutely nothing when you are 20/21 years of age and looking to spend the rest of your life with someone.
I truly believe you guys are in love and wish you well, but chose your path wisely. |

Per my understanding (reading about VWP) one cannot adjust status while being in the US by VWP. Am I right?
What about holding an already existed B1/B2 visa and while staying in the US to adjust status? That exactly what happened to me. I got engaged my last visiting and stayed (not overstayed! since I had 6 months to stay...and quit my job for him who left me but it is another story...sorry) and did AOS. Per my understanding defoe cannot do that under VWP? However, he could get married in the US under VWP and then go home and start the process from home and wait, right? Or go home, get fiance visa since he cannot come back with a normal visa or VWR after knowing that the purpose of the US visit would be marriage (ie. AOS) and not simple visit. Sorry if I ask or say dumb things... |

Ok, JG, at the risk of hi-jacking the thread, thanks for that.
I had even forgotten that my wife joined the forum last year in order to ask some questions before we set off on our immigration journey. I signed up in the UK after getting my Visa in order to share my experiences and hopefully pick up some useful advice as I settle into life in a foreign land. I apologise for not studying site rules sufficiently but we actually weren't in the same household when the said accounts were created. Thanks again Matt. |

If you were to go back and apply for a visa you guys can still visit each other while it's processing having the distance can be good for your relationship it can make it stronger, you learn a lot about each other, and it will make you both appreciate each other more when you are together. Marriage lasts for a lifetime after all what's a few months?

Thanks for correcting me sunflwgrl13. I hardly have any knowledge and zero experience in VWP. I was just curious about the difference between applying for AOS on the VWP and on an existing visa, like B1/B2. Nothing then? I should be better reading the link you sent. Thanks again.

That is incorrect. It is legal to apply for AOS if one gets married in the US on the VWP.. However, it comes with certain risks that a couple should be aware of. Do a search on this forum for "10foot pole" (as in "I wouldn't touch that with a 10ft pole").
