This is not true. Someone on the VWP is allowed to get married and file for AOS, it's legal. Whether it's successful or not is another story.

It is illegal to use the VWP with having prior intent to stay in the USA and adjust status to permanent resident.

Hello Rene thanks for your comments, just wanted to ask you what are the chances of it being unsuccesful?

With what?
What is so difficult about saying what you want to do?

The point about other people telling you what they did is that your circumstances might be completely different than yours and therefore completely not applicable. Therefore, what's the point of answering?

You need to expect more than 15 minutes worth of study if you want to learn anything about moving to the US (and we still don't know if that's your objection or not).

I could quite happily phone my workplace in england tomorrow and my family and tell them I will get married because I will just to be with one person as soppy as it sounds. I just dont want to be heartbroken to the point where I may have to go back to England :(

Well, the BEST way forward, would be for you to return to the UK before your 90 days is up, and either go for a K-1 fiance visa or a CR-1 Immigrant Visa, depending on whether you marry in the USA or not. If your relationship with Amy is as strong as you say it is, 6 to 8 months apart is not going to end the relationship.

Otherwise, if you want to try to AOS, you need to have that consultation with an attorney.

Right, so since you're not even legal drinking age here yet (you're not breaking any laws are you?) a few months in the Big Picture will be nothing.

You can get married. Then go home and apply for the right visa to move here and get your green card automatically. There is very little legal downside to this move.

The VWP you signed also said you were a visitor, and that you'd leave after your 90 day admission.
If you two are going to persist with the idea of you staying on this visit, I strongly recommend that you get a lawyer to help you; you don't seem to be grasping what is being said here very clearly?
You might ask Amy to register, maybe it will be clearer to her? Then she can read the part about the financial contract she needs to sign, and the part about how much money she needs to be earning to sponsor you etc.

You going home, married and ready to start the immigration process, will give her enough time to get what she needs organized.

Thanks again, I think I will try and stay here and try the route from here. Do we get married before we see a lawyer or somewhat or see them 1st? what will happen if we just go get married? lol

You don't know yet if you qualify to do this!
Go see a lawyer FIRST.

If you just go get married, you limit your options. GET CLEAR on this please: getting married does NOTHING for your immigration status. It's not like the movies.
You're obsessed with the act of getting married, which is NOT going to keep you legal in the US.

If you promise to stop saying "lol" so much then yes...

How about some marriage advice...

Bearing in mind you are very young...think very carefully about what you are doing...you barely know each other...it could well be a disaster in the making..try being engaged for a while and getting to know each other and getting past the lust phase...after all, whats the rush..really.

With respect, you have no idea what you're getting yourself into... and every post you make confirms the fact that you really have no understanding of the process.

US immigration doesn't care how old you are, or how much in love you are, or even that you want to remain with her... but if you start down the wrong path, you may find yourself separated from Amy... by force, courtesy of the US government.

Don't be an idiot, and don't act as though this is some walk in the park. If you really care about her, as you claim to, you'll start paying attention and stop thinking with your hormones.

Ian
