a little OT, sorta: College in the US with a K3
Hi everyone,
With any luck, my K3 should be approved in a few months, probably right
after I finish up my first year of university (college, whatever) up here in
Canada. Does anyone know what category I would be placed in, if I decided to
go to college once I'm down there with my hubby? At first we were thinking
I'd just have to pay out-of-state, unless I waited the 6 months to be
considered a permanent resident of Indiana, but since the K3 is a
non-immigrant visa, would I still be considered an international student?
And, if so, would I still be considered an international student, and have
to pay international fees, until the I-130 is approved?
I know it's more or less a question for the admissions office at IUK, but I
thought I'd ask both places, see if anyone here had been in a similar
situation

IUK's answer is the only one that counts. I have seen it handled
multiple ways and it appears to be locally interpreted, or maybe even up
to the individual person handling it.

I'm pretty sure you have to be an F1 visa to be an international student. I'm an F1 at the moment... just got married and am waiting for AOS. Once I get my temp. work visa I am changing from F1 (I am a Grad student so need work auth. to get my assistantship) , but I know once I get my AOS I will give up my F status at the school. I imagine you would be classed as out of state initially (depending on when you started). I am pretty sure to be classed as an International student they school has to be your sponsor to get you a visa JUST to come over and study - this is a non-immigrant visa, so not applicable to you anyway.

I would consult with the school. I will admit to not being all that familiar with the SEVIS system now in place. Before SEVIS, I know that there was no probelm with a long term non-immigrant such as an E dependent, H-4, L-2 attending school. I seem to remember that that is no longer true for higher education -- but I'm not so sure on that.
