k3/k4 visa denied in ecuador
Well, as expected my wife's k3 visa was denied due to her illegal
overstay for more than 180 days. She has the 10 year bar. They gave
her the 601 waiver application which we plan to file as soon as we get
a good lawyer. We have been separated since feb/02 and the waiver
could take up to a year to process after filing, and it's not a sure
thing we would get it, since I don't have any medical issues, or any
"extreme" hardships in their eyes....
thank you for your help, I'll probably have more questions in the
next few weeks...

That is really sad. My only advice would be to hire an Excellent lawyer. I really wish you the best of luck and I hope everything turns out well.

I don't think the waiver will take a year to process. I've heard of them going
through in just one to three months. As far as extreme hardship goes, what
would the quality of your life be in her country? Do you speak the language?
Could you work and earn enough to survive there? Can you receive adequate
medical care? What/who would you have to abandon if you left this country to
live there? If you do your homework and compose your hardship letter with a
lot of thought, you'll come up with a lot. Don't despair.
