K1 visa and delayed name checks. How long it can last?
We've been waiting for our name check to end since March, 2006. Almost
a year. And we applied for K1 (supposed to be the fastest way to be
together) in 2005. The congresswoman we asked for help 2 times was
absolutely useless. All we know now is that our case is on a name
check in FBI. She rejected to call FBI, said they have certain quota
for inquires, so she wouldn't write or call there. Senator that got
our letter with the same request sent back some BS news-letter 6
months ago. Going crazy here. Some ill-mannered woman at NVC shouted
at us and said that our case is not that bad, there were applicants
that had to wait for 20 years!!!!! Going crazy here. Is there any way
to ASK people in FBI?

I suggest you give it more time, make a couple of visits to your local
office to seek more information, then if you still do not get your green
card, go see a lawyer and ask about a Writ of Mandamus.
You need to show that you have exhausted all your options, with letters,
visits etc, then consider a legal remedy. Ask your lawyer about a writ of
mandamus.
We are considering the same thing, my name check still has'nt been completed
after 2 years.

Thing is, I'm not in the US even. And can't be with my boyfriend cause
the only way for us to be together is to apply for that K1. Tourist
visa are normally denied for single girls from my country. We applied
for K1 FIANCEE visa. Which normally takes about 6 months. They sent my
case to FBI for additional security clearance, the congreperson's
assistnat said it supposedly is a namecheck. So, we're not even
married yet, but applied in 2005. I understand when it takes 2 years
to clear a person that's already in the US, applied for AOS and all.
But fr K1 visa it's absolutely outrageous. I only am going to go
through all these namechecks again after we get married. And I even am
not sure if i get the visa at the intervew....and they already putting
me through all this BS. Normally it takes 2-3 weeks for them to
check on a person that applied for K1. With me, it's been almost a
year.... I could wait forever, if only we could be together now.
Wating for it and being apart for years is double stress. We live on
the opposite ends of the planet.
