Default K-1 or VW... Which is Better?

Hello… I’m new to this forum.

As a yellow-bellied wimp and loser, I’d like to ask your opinion about getting a K-1 visa so I (UKC) can enter the US to marry the girl (USC) of my dreams… all nice and legal. I have spoken to several friends who suggest it would be a lot easier to simply get a visa waiver, enter the US, get married and stay to adjust my status. On the surface this seems like a reasonable course of action, but doesn’t it violate both the terms and the spirit of the visa waiver? Would I be opening myself up to any sort of legal consequences? I’ve never before been in trouble with the law and I truly believe that this is hardly a propitious moment to start, don’t you think?

So, is the K-1 right for me, or should I just throw all caution to the wind and use the VW as suggested? Thanks for your help!

Your post says it all: a yellow-bellied wimp and loser. Therefore the K1 is for you. However, unless you have already divorced your current wife, you will probably be restricted to a few small towns on the Arizona and Utah border. The scenery there is, you'll be glad to hear, very beautiful.

Based on your vocabulary, you seem ready for the more sophisticated CR-1 Immigrant Visa.
Get married in Vegas on the VWP and fly home so your new wife can file I-130 for you.

Yes, it violates the terms of the VW.

If you want to do it correctly (and not by breaking any laws), you have 2 choices:
K1 - Fiance Visa - Apply, plan wedding after it's approved
K3 - Spousal Visa - Come on VW, get married, send in I-130, leave the US before your 90 days on the VW, send in I-129F, come home after K3 approved.

Both have their merits.
