K-1 visa for the Netherlands
Hi,
I want to marry my fiancee in America and need a K-1 visa. But currently I
am still married. Does the INS accept the so-called speed divorce in the
Netherlands? According to this procedure a marriage is transferred to a
registered partnership. After that the partnership is dissolved. Is this
what the INS calls annulment of a marriage?
Nor INS or dutch USconsulate knows the answer.

I think Maarten knew somebody who did that(used the speedy divorce from
NL).....ask him about it.

De fast method of Divorcing in The Netherlands is only accepted by the U.S.
Consulate in Amsterdam, as they have methods to verify it more easily then
the USCIS in the United States does. A couple that had this "problem" was
able to get a lawyer to sign off a letter in English stating that the Dutch
documents with information on the "snelscheiding" was official documentation
and valid proof that the person in question was indeed legally divorced. The
U.S. Consulate accepted this letter. The U.S. Consulate has Dutch employees
as well who are able to at least verify whether Dutch documentation is
official and valid.
The problem with the "snelscheiding" is that there is no international
documentation for it, only in Dutch, where with a "normal" divorce you can
get an International Divorce Degree that is accepted by the USCIS. For as
far as I know the Dutch "snelscheiding" documentation together with a letter
from a Lawyer is the ONLY exception where Dutch documentation is accepted
over an International (English) version of the Divorce Decree.
Basically you have 2 routes:
1) Divorce normally.
2) Apply for K-1
3) Get married again within 90 days after you enter the U.S.
or
1) Divorce "quickly" using the "snelscheiding" method.
2) Get married again (in U.S. or NL, does not matter)
3) Start I-130 DCF process through the U.S. Consulate in Amsterdam
Since K-1 can easily take up to 9 months before you get your work permit, I
recommend doing option nr. 2 as DCF gets you done and ready in about 8 weeks
time, sometimes even faster. Eileen has a couple on her website that was
able to do it in less then 30 days I believe!

Ack! Hit send too soon. I wanted to add that I know of a couple who DCF'd in Amsterdam this past August and it took them all of 28 days!
