I-94 required while I-485 pending?

Is it required to maintain a valid I-94 status while one has I-485 application
pending? My lawyers say that it is not necessary, but I just want to make sure, since
I haven't currently relinquished my non-immigrant status. My I-94 has expired more
than a month ago. I have also applied for EAD and I intend to relinquish my
non-immigrant status by using it, but I still haven't received the EAD yet.

My question was not if I am allowed to work; I don't currently work. My question was
if I am in legal status after my I-94 has expired, but I-485 is pending.
Do I need to apply for I-94 extension, or is it sufficient that I have I-485 pending?

The I-94 could have expired on the day you filed Form I-485, and never have been
extended, and your stay in the U.S. would still be authorized during the pendency of
