Default I-864 insuffisant income

Hello,

I am married to a USC since a month. We are now trying to do all the
paperwork for the adjustment to permanent resident.
For the I-864, the 125% poverty line is $16,037 but on the last tax
transcript of my wife her income is $15,200, and on the 2 other one
it's even less than that.
Please help, we don't know what to do :(

Hi:

What is her income NOW? Do YOU have a job? How long have you lived together? Any possiblity of a joint sponsor. What liguid assets does she own? You can add 20% of those assets to the income.

You don't give anywhere near enough facts to answer.

BTW, it is a common myth that the tax return is the only method of showing that you satisfy the requirements.

For the next income tax she will be over $16000.
We just move together.
She don't have liquid asset now, but if we put $4000 on a saving will
it be ok to meet the requirement.
My income is $40,000.
Did the joint sponsor can be a friend ?

Current income level in the US? If so, I should think this shoudl be more
than sufficient.

If her current job pays more than the poverty guidelines, you might be OK. She has to make enough money *now* to satisfy the guidelines. It doesn't say anything about having met the income requirement in the past 3 years. The officer who interviews you for your AOS will make the final decision on whether your wife qualifies to be a sponsor, and they will base their decision on the evidence you provide, including her current income and past earnings history. They are making a judgment on the likelihood of her being able to maintain her current income level for the foreseeable future.

Also, if you have been married and living together for more than 6 months, you can count your income too. Even if you haven't been married 6 months yet, hopefully you will be by the time of the interview and can add your income to hers (in an updated I-864 that you can provide at the interview).

You can get a joint sponsor just in case, but chances are you can use your income by the time the interview comes around, and you won't need the joint sponsor. The joint sponsor doesn't have to be related to either of you (can be a friend) -- they just need to be either a citizen or LPR, live in the US, and be 18 years or older. And of course they have to fulfill the income requirements for their household size + you.

And yes, you can put some money in a savings account and that would count as assets... if you put $4,000, that would make up for an $800 shortfall in income. But if she's going to make over $16,037 or whatever it is this year, I don't think you'll need to show the assets.

Since the OP's income now is $40,000, and since it will be at least six
months until the interview, I should think things will work out by
interview time if the situation stays the same. An I-864A submitted at
the interview would do the trick.
