I-130 timeline without K3 (Canadian spouse)
I am interested in hearing from other Canadian spouses who have
successfully gained permanent residency without going the K3 route. I
am Canadian, but my husband is American. We were married (less than a
year ago) in another third-country which disqualifies us from getting
the K3, since we are now back in North America and not able to process
papers in the said third-country. I'd like to know how long Canadian
spouses had to wait for a response after filing the I-130. We haven't
filed yet, but intend to shortly. I'd appreciate any advice I can get.

Also the length of time depends on which state your husband lives in. I am here on my K-3 from Canada and because we live in Tennessee we had to send our I-130 application into the Texas Service center which is currently processing applications from 2 and a half years ago. If you have to go thru Texas, I would definitely advise that you try for the K-3 if you can, most other centers are much quicker... I think I remember reading someone going thru the Vermont center that it only took 10 months. Check on the I-130 application as to which Service Center covers the state your husband lives in.

place. I realize that information on non-government sites is not
always reliable, so I guess the only way to confirm this would be for
us to call the California office and speak with an immigration
officer. If the K3 is available for my situation, I'd go that route
in an instant.

That is correct. You must interview for the K-3 in the country where your marriage was performed. So if you are Canadian but married in Sweden, you are suppose to interview for the K-3 in Sweden after the USCIS processes its portion in the US. Don't know what the scope is if you married in the US. You can't interview for the K-3 in the US so possibly you might have to interview in your country of citizenship or where you are living with legal residency. An attorney will know the answer to that. I'm just surmizing here

Hi,
I am Canadian married wonderful american wife, living in North Carolina. We married in US almost three years ago, my wife lived with me in Toronto for over year and a half, than we decided move to US. Applied for K-3, did not have interview at that time, now waiting for my AOS. Already have my EAD authorization and work as well. Regarding I -130 already waiting for over a year and as per BCIS page it will take up to 999 days. I think for you K-3 would be one the fastest way to join your husband.

I am a USC in Alaska married to a Canadian. Because I am in Alaska, we have
to use the Nebraska Service Center. The first NOA was July 1, 2002.
Initially, they were only taking 4-5 months, but about every three months
they change the time line for another three months. We are still waiting.
This constant misinformation has been going on now for over a year.
I also vaguely remember reading that there were two different ways that you
could qualify for the K3.
We didn't apply for the K3 based on legal advice (which turned out to be
based on the misinformation provided by Immigration.)
