I-130 approved - now what?

Default I-130 approved - now what?

I hired one of those internet lawyers. From a Visa Journal Ad or some
where like that.
I sent him all my papers to file a K-3 VISA for a lady I married in
Colombia.
He sent the I-130 February 21, 2006. I received a NOA March 2, 2006
with a case number.
I kept emailing the lawyer about filing the I-129f he ignored my
emails and didn't answer his phone.
After 1 month I emailed him and told him to return all my papers. I
don't need his help no more. He never filed the I-129f.
After my papers arrived. I contacted another lawyer. He told me it may
not be worth it to file a I-129f because the I130 may be approved
sooner then the I-129f.
So now I get a NOA that the I-130 has been approved. June 8, 2006

It says this.
The above petition has been approved. The petition indicates that the
person for whom you are petitioning is in the United States and will
apply for adjustment of status. BLA BLA BLA.
My wife is not here…..
The official notice has been mailed to the attorney or representive
indicated above. Any relevant documentation included in the notice was
also mailed as part of the official notice.

So what do we do now? Are they going to send her papers? Is Bogotá
going to call her?
Does the lawyer have all the papers for my next step?

Since you didn't get a copy of what that first lawyer submitted, you really don't know what he did, and it sounds like he goofed somewhere. Your wife is not here in the USA and cannot adjust status. If USCIS thinks she is in the USA, they won't be sending any papers to Bogota. What does the 2nd lawyer that you contacted say? If he's someone you can meet with in person to view paperwork together, I would continue with his services to get the mess straigtened out and see how he advises you to proceed.

I noticed the NOA also says this.

file form _824, Application for Action on an Approved Application or
Petition, which this office to request that we send the petition to
the Department of State National Visa Center (NVC).

So I guess she needs to send me a I-824 to send to somebode at some
palce.

Well, here is the form I-824: http://www.uscis.gov/graphics/formsf...iles/I-824.pdf To me, it looks like something YOU fill out, not the alien. I also don't really see how this form pertains to your situation, but I'm no lawyer. My advice...take your NOA to the second lawyer you talked to, and have him help you with your case. Sounds too complicated for an online newsgroup.

The first lawyer finally called me.
He said it was very unusual for an I-130 to be approved so fast.
Usually takes a year.
He thinks the reason is they think she's here. But nothing in none of
the papers indicates she is here or that we married here. We just got
lucky.
He said I need to file a I-824 to get her in the VISA Center Process
Thingie.
Then they will send her paper work to I guess Bogotá.

On the I-824, Part 2. I'm guessing box "B"
And write in "Bogotá, Colombia S.A."

Part 3
1. That should be "I-130"
2. What are they asking in plain English please.
3. 3. This is my info right?

What do you mean, what are they asking? Just read the questions and answer them appropriately. I don't know the answers, since I don't know your information, but it seems pretty clear what they are asking for in each box.

No. Seems to me this would be HER information. It says the main beneficiary of the original petition. You are the petitioner, she is the beneficiary. That's the way I read it, anyway.

But, just to make sure, why don't you take the form to your lawyer(s) and have them help you complete it...that way it will all be very clear and filled in correctly.

Joe,
Ask your "lawyer" to look at the last page of the I-130 and tell YOU if he indicated that your wife is in the US or not. You *should* have a copy of the I-130 yourself if you want to look.

I-130s have not taken a year to approve in over a year--I'd suggest your lawyer is not very current on family based applications.

The speed of approval has nothing to do with where USCIS or DOS think your wife is.

Why isn't the lawyer filing the I-824 at his expense to correct the error, if indeed HE made the error?

after a case number was issued, I emailed him every day about the
I-129f. He ignored me for 4 weeks. I then asked him to return all my
papers. I contacted another lawyer. the second lawyer said I can file
a I-129f but after waiting so loong, the I-130 might be approved
first. So I bit my tounge, and waited, I received the NOA on the I-130
as stated above.
On the last page of the I-130 that I sent the first lawyer is like
this
17. me as the husband
18. my address
19.her address in colombia
20.n/a
21.her address
22. first City and Stae or blank, second apply for visa abroad is
Bogta Colombia.

I did some google on the I-824, adn all I'm reading is that the I-824
is for a copy of the original approval.
