Default F-1 practical training

Hello,
a couple of questions on the F-1 practical training.

My brother just graduated with a BS and has
applied for the practical training permit for
over 3 months now. His F-1 visa expires on Sept. 03.

1. How long does it typically take to get practical
traning permit from INS?

2. Is it possible to get it by showing up at the
office?

3. How long can one stay in the country after getting
permit, but still looking for employment?

4. Does the 1-year training start from the day the
person begins employment? And who extends his visa?

5. Can one work for a company for free during their
1-year training?

6. Is there anyone out there who can provide some
help as to which companies typically hire practical
traning folks?

6. If one doesn't find employment, can he re-enroll
in an university for MS program?

This is called an employment authorization document (EAD) for F-1 optional
practical training. The processing times are different for different INS
Service Centers. See http://www.shusterman.com/toc-sc.html. At INS-CSC,
the usual processing time appears to be over 7 months.

It is not possible to get the *actual* EAD by showing up at the INS Service
Center. The Service Centers do not have the capability of issuing EADs in
person, only by mail. However, when 90 days have passed since the I-765 was
filed, the person can "show up" at the INS district office, and obtain an
interim EAD which is valid for 240 days. This allows enough time for the
actual EAD to arrive by mail.

Until the expiration date of the EAD.

No. It starts from the day that the Designated School Official recommends
on the I-20 filed with the I-765. This is usually the graduation date.

The visa is another matter entirely. A new visa is required only if the
person leaves the U.S. and wishes to re-enter. The U.S. consular post at
which the person applies issues the new visa. It is not a good idea to
leave the U.S. and apply for another visa stamp until an EAD has been
obtained and the person holds a job. Without that, the risk of visa denial
is fairly high.

Yes, if such work otherwise complies with labor laws.

The Career Center at the school is usually able to provide some guidance
with this. Otherwise, the job search is a typical search for any job
position in the field. The applicant should be prepared to answer questions
about F-1 OPT. It is a good idea to have a relationship with a good
immigration attorney who would be willing to speak with anyone from the
company who needs information. The applicant can offer the interview the
attorney's card.

Yes, if all the steps and paperwork are carried out in a timely way.
