Experience letter from old employer for GC application

Default Experience letter from old employer for GC application

I have a question. Here are the details before I ask the question.

1. I used to work for an Indian firm in India.
2.They sent me to USA on H1B. On my LCA, employer name/address was of
USA office of the Indian company.
3. When we are sent to USA, our Indian firm makes us sign an agreement
that we can not leave the firm from USA else we will have to pay a
heavy penalty.
4.I left the firm while in USA and joined another company. I faxed my
resignation to our USA office.
5.To my knowledge their aggrement is not valid in USA. In past our
firm has lost a legal case in USA, against an employee who had
similarly resigned from USA.
6.Now when I contact the USA office of my old firm for experience
letter, they ask me to get it from Indian office. When I contact
Indian office they ask me for heavy penalty .

Question : Is USA office of my old employer, legally obliged to issue
me an experience letter without asking for any penalty which is not
valid in USA.

Your old company has no obligation whatsoever to give you any letter. If they
don't want to they don't have to. A lot of companies these days don't want to
issue any information other than to confirm your dates of employment. That can
be done over the phone...

as far as I know companies dont have to give out any information about your
employment with them other than confirm dates. Actually a big company a
friend of mine works at has a policy that if someone calls to ask for
references they can only say, yes, he/she worked here for so many
moths/years, even if that person was a good employer, I guess they are
trying to protect themselves from law suits.
