EAD and 90 day wait

Default EAD and 90 day wait

Some time ago, someone on this group posted that if you applied for a
renewal EAD and waited the 90 days and it didn't show up, you were permitted
to begin working again. Is this true? Where do I find documentation of
this that I could present to my employer?

When I tried that, they told me to come back a month later. They
changed it from 90 days to 90 businessdays...

Ouch!

Is it actually true that INS now ok's people to work with expired EAD's ?
while waiting for their renewed EAD to come ? I just read this in an INS
forum last night.

I also read that they are very hesitant to give interim EAD's these days
because it screws up their internal database, etc and hate giving them.

One of the reasons the main INS site bumped the mailing of renewal
EAD application to 6 months.

This is from INS' site... print it and go ask for an
interim one... the only drawback is that I live 1 hour
away from INS, and everytime I have to take a half
day from work..

What is an Employment Authorization Document?

U.S. employers must check to make sure all employees, regardless of
citizenship or national origin, are allowed to work in the United States.
If you are not a citizen or a lawful permanent resident, you may need to
apply for an Employment Authorization Document (EAD) to prove you may
work in the United States.

INS issues Employment Authorization Documents (EAD) in the following
categories:

EAD: This document proves your are allowed to work in the United States.

Renewal EAD: You should apply for a renewal EAD six months before your
original EAD expires.

Replacement EAD: This document replaces a lost, stolen, or mutilated EAD.
A replacement EAD also replaces an EAD that was issued with incorrect
information, such as a misspelled name.

Interim EAD: If INS does not approve or deny your EAD application within
90 days (within 30 days for an asylum applicant; note: asylum applicants
are eligible to file for EADs only after waiting 150 days from the date
they filed their properly completed original asylum applications), you
may request an interim EAD document.
