Black Label,
You may be right and the time line could be same.
However, once my wife enters USA she will get a Green Card and We will not have to do any AOS or Work visa.
Moreover, I have read on this forum that the AOS timeline is about 6 months to a year and time line for work visa is abt 30-90 days.
So you see if I can get DCF approved at New Delhi india, we will not have to wait for her green card.
Thank you,
Bhavesh Shah

You're wrong on this one buddy. If he filed in February, his K3
timeline will take much longer than a DCF. He's looking at at least
an extra 4-5 months just to bring her over here.
Bhavesh, IF they don't entertain your app, which is highly unlikely
unless you have other mitigating circumstances which you have not
communicated, you will not hurt your original I-130.
I don't want to persuade you for one route or the other...just stating
my experiences and how long I think it will take for the two different
routes. My ultimate goal was to be reunited with my wife as soon as
possible....the DCF was my thing.

Guys,
I am really thankful to all of you people on this NG.
I just called the New Delhi Office and they told me that I could re-file my I-130 petition in India. The re-filing will not affect my current I-130 process.
However, They also told me to call them before I go over there to check any new process the have put into place due to INS transition march 1st.
Does anyone know if the Transition is going to affect/change the CR-1 (DCF) process in New Delhi?
Anyway, I am planning to go in First week of march and hope they will not change the process.
Thank you,
Bhavesh Shah
