Default conditional status

My wife and I are getting ready to file the I-751 lift conditional
status. We do have one snag. she sent her passport to her embassy last
June and they still have not returned it. We have waited as long as we
can to file the I-751 now I am thinking that we need to get an
extintion. The passport is months away from getting back to us. Her
embassy (moldova) stated that we can check back in 3 months if we have
not heard from them. Does anyone have any suggestions on how to write
the letter requesting an extention. Also any other tid bits of info
would be appretiated.

Hi:

You don't need her passport to file an I-751. LPR's don't even need a PP from their home country.

File away.

As Mr. F stated, your wife does not need her passport to file for I-751. Unless, of course, she never recieved a green card in the mail and is relying on the I-551 in her passport as proof of residency.

If you read the instruction sheets for the I-751 you will see what is required of her and there is no extension given for the filing. It must be filed prior to the expiration of her conditional green card.

She does not need her passport either for an extension I-551 stamp as she will receive in the mail an I-797 extending her green card for one year. That paper will give her all the same rights (in writing) that the card does.
