Apply for AOS after 1,5 yrs marriage

Default Apply for AOS after 1,5 yrs marriage

I got married 08/29/2002. at that time me and my husband have a very difficult financial but right now we 're getting better. We plan to apply for my AOS when we get the Tax Return. My visa already expired when we got married but I hope it will be ok. I have a 7 yrs stepson who thinks that I am his real mom, and since his bio-mother never call him for 1 yr and 3 months, I plan to adopt him when I get all my paper. I just need advice from all of you here about my situation. I just dont want to get deported because I really love my husband. I married him and only a month after married, me & my husband went to Pensylvania to get his son from government (He got abused from his Bio Mother) and since then, I am a wife and a mother.
Please send me reply if you know something about my situation. And one more thing, my husband being in the military will help me with my case?

It sounds like you should be OK. You don't even need to wait for the tax
return; you can file at any time. If previous year's tax returns don't
show enough income, simply include pay stubs or other evidence showing
that your husband now makes enough. And, yes, your husband being in the
military will help in quite a few ways. First, he needs less income in the
first place (everybody else needs 125% of the poverty level; military
needs only 100%). Second, it supports his assertion that this is a stable
future income, not just a fluke of higher income in 2002. And third, once
you have your Green Card, it is possible (if he is transferred out of the
USA) that you can apply for citizenship immediately instead of waiting the
usual three years. I'm not all that familiar with the internals of the
military, but it is entirely possible that military lawyers will be able
to help you with filling out the forms. I hear that in this kind of
respect, the military takes decent care of their own. If they offer,
avoid allowing the military to process the paperwork, though. I hear that
any type of paperwork processing can be even slower in the military than
in the civilian CIS.

Also, if you need help - you probably don't even need it - contact your
Congressperson. Yours is the kind of story they love because it
touches people. So they might well be willing to go out of the way to help
you more than they would help others. Similarly, if you need publicity
(again, it is unlikely that you would even need it), newspapers would
probably be interested.

Overall, from what you wrote, it sounds as if you have a very strong case.
Don't expect 100% smooth sailing, but no major glitches, either.

I can't file my papers now because My husband just got discharged from his civilian job while he was sick. Now he is looking for a job. I hope he will find a job soon.
I have a friend in Maryland and married a military and she got approved in Interview (November 2003) and got stamped and this month(January 2004) she received the actual greencard. She sent her first package at May 2003. I hope my case will be like her. Fast and smooth.
