AOS/K1 Question
Hi all. I just spoke with someone at the INS regarding an AOS (I-485) that
we just filed at the Dallas office. I was a bit concerned because the 90
days since my fiance' (now my wife) entered the US is almost up. I wondered
what might happen if we didn't get a receipt back before the 90 days was up.
The INS agent told me that there was no time restriction where she would
have to leave, nor was there an AOS filing deadline, so long as we got
married within 90 days of entry. I thought we at least had to have a receipt
for the AOS within 90 days of entry or she'd have to leave. Is the agent
correct?
If anyone's interested, here are the averages he offered me for filings at
the Dallas office (not the service center):
EAD - 3 months
AP - up to 3 months
AOS - 30 months
30-45 days for notice
Best to all,
Dave

As long as you're married your wife is ok, I don't know what happens after a
few months, but the 30-45 days for the notice aren't a problem.

Re: AOS/K1 Question
Hi Dave,
I wouldn't worry at all. We got married well within the 90 days but
due to a misunderstanding on our behalf it took ages before we got the
marriage certificate so we could file the AOS. We filed that on about
day 145 and the INS didn't even comment on it!
