Default AOS Interview RESCHEDULED DUE TO INS ERROR!!!!!

We were so ready!

Our AOS interview was scheduled today at 10:40am in the chicago INS
office in Dearborn. My wife and I went in the building around 10am as
advised by my lawyer. We went to the 2nd floor were we presented our
appointment letter. We sat down in a room with about 50+ people, all
waiting for their turn.

At 10:30am, our lawyer walked in. He went to us and asked about our
documents. He gave us instructions (and the whole room for that matter
since his voice was SO loud, everyone can hear). So after the whole
room knew about our story, we waited for our names to be called. At
around 11am, my name was called and we were instructed to go to the
23rd floor.

In the 23rd floor, we had to sit in another waiting area. This time its
quite. Everyone seemed so tense. Around 11:15am my name was called by
the INS Officer, as we approached, she had a smile on her face more
like an apologetic smile. She then started saying "We can't do you
interview today."

My lawyer exclaimed "OH NO!" with a huge smile on his face (he knew the
officer). She then strated explaining that our file was not forwarded
to them by the missouri office, so we have they will have to reschedule
our appointment.

I can't believe it. She told us it will be around 3 weeks before we
hear about it. Our lawyer told us that this things rarely happens and
that it's unfortunate that it had to happen to us. He said that he will
not charge us for that interview (was he even thinking of charging us
again?) because INS screwed up.

So now we are gonna wait for 3 weeks and then call our lawyer if we
don't receive anything.

Waster day. Wasted vacation day at work. Just when we thought we will
finally see the end of this.........we're still waiting.

Here's out timeline:
Jan, 2005 filed for AOS
April, 2005 received Interview sched for Aug 2005 (7 months after
filing)

I knew it was too fast to be true!!! 7 months from filing and i got an
interview. Oh well!!!

Hi:

Crap happens. What happened to you is rare. But it does happen. I smile at the officer and say that my client here is mighty pissed, what is your pleasure. Should I go to the cafetria for coffee while client screams at you or should I take him with me to the caferteria with me and drink milk while he screams at me instead?

The officer there was helpless and was as nice about it as they could be. I reserve my rants for really outrageous stuff. And BTW, the DAO's are so suprised when **I** rant, they listen. Sometimes I wonder if my G-28's are used for training sessions in which a new officer sits in and observes.

Believe it or not, you are lucky they didn't interview you.

We had the interview, gave all the documents, answered all the questions and was told we could not be approved because the file had not been returned from Lee's Summit. It was only a stroke of luck that got us an approval notice in two months.

If you had the interview and was tentatively approved I would bet the farm that you would be still waiting for final adjudication of your AOS six or more months after the interview. Why? Because with the number of cases each DAO has to work on, your file would have sat on a floor or shelf in the building and only aftering having lost countless vacation days with you trying to get someone to finalize your AOS by visiting the CIS office or the added fees to have your attorney follow up. Far better to have lost one day and have the interview with your file there and have approval the same day.

Count your blessings.

I also think that your lawyer was awfully nice about this. I would have
charged for the time.

Hmmmmm...I wonder just how rarely this does happen. David and Chris had their AOS interviews in Chicago on August 10th. While we were waiting on the 2nd floor, a girl was called up to the window and was told that her file didn't make it from the Missouri office and they could not hold her interview either.

I was terrified something like that was going to happen, too. After we went to the 23rd floor and our names were called, the adjudicator only had Chris' (the K-2) file in his hand....my heart went into my throat! We told him that he should have two files and he said to wait a moment while he checked. I breathed a sigh of relief when he turned up with David's file as well!!!!

Sorry that you are delayed and hope that you get rescheduled soon.

Our interview was delayed because of INS error. Our error was not that the file hadn't reached the office, but because they scheduled our appointment for a Saturday. Then, shortly before the date of the interview, they called us to say, oops, sorry, we don't do interviews on Saturdays and we will have to reschedule. Of course, the earliest appointment we could then get was three weeks later (must be the standard response when they make a mistake).

Still, no problems after that. The appointment three weeks later went off without a hitch. And I agree with the earlier commenter - you're lucky your attorney waived his fee for the day - not many would.
