Just as an update to this, I have spoken directly to the attorney being retained by the company (his name has been mentioned before on this forum with good reports so that was encouraging).
He seemed confident that the E2 would be granted, even given the circumstances. His opinion was also that, in the unlikely event it wasn't, then it wasn't a big deal, we would then petition for a L1.
My interview at the embassy is booked for the 22nd June - must try not to be too nervous!

Further update.... Had my interview today and it was a total anticlimax! Didn't even ask me about my marriage and asked about 2 questions about my job.... Interview was done in 2 minutes and I was approved!!
