485 Interview scheduled, but living in separate places

Default 485 Interview scheduled, but living in separate places

Hi,

I am posting here for the first time ...

I am on a L-1 visa working in Boston, MA and my husband is a USC living
in CA. We were married in August 2005. We filed the AoS petition etc
for me in Feb this year (Feb 15th).

I was planning to quit my job at the end of May (have terminated my
apartment lease with effect from June 1st) and move to CA. And change
the address so that we receive the interview in CA.

However, we have now received the notice to appear for the interview on
May 19th. We are trying to put together the documentation for the
interview - we have just filed a joint federal and CA state return (MA
filing separately return since MA doesn't allow joint returns unless
both people are resident here), and have a joint bank account. But we
don't obviously don't have any other joint documentation (utility
bills, insurance, credit cards etc).

We do have:
1) email correspondence going back 2 years when we first met and wrote
to each other (I lived in UK at the time) to the present
2) wedding invite / pictures
3) flight boarding passes (my flights to CA, maybe his itineraries for
his trips here)
4) (we can get) affidavits from family / siblings

Will this be sufficient? Or should we postpone this interview - which
will give us the time to move, and start building our life together
before we get to the interview ?

Bring those to the interview if you want to, but the AOS interview is to determine your current ongoing relationship, not how you previously stayed in touch.

Bring these just in case it comes up and the officer wants to see proof that you're visiting each other.

Sure, bring them just in case. Couldn't hurt.

Will this be sufficient?
Maybe, maybe not. It's all up to the Officer to determine if you have enough proof. Bring the joint tax return and your joint bank statements. Bring anything else you can think of that shows both your names on it...credit cards, health insurance cards, membership cards...are you each the beneficiary on any insurances or anything? Both your names could have been added on utilitily bills, although too late now. All you can do is bring what you have.

Or should we postpone this interview - which

before we get to the interview ?
Whatever you do, don't postpone the interview.

Just to let you know, my husband works in Los Angeles, while I stay in Phoenix, where we live. His place of residence is Phoenix. He's self-employed, so he found work in LA for the time being until he can build a business in Phoenix. But, his mailing address and all our joint paperwork comes to our home in Phoenix. My husband was approved with no problems, and the subject of where he works never came up at the interview.

Thanks for your reply!

I guess we will have to just put together whatever we have at the
moment.

Oh - and both of us have all (most!) of the emails we have sent each
other - we met 2 years ago ... but they also reflect the stuff that we
are exchanging today (like looking for apartments in CA etc). I guess
we might have to print out and arrange these in chronological order to
show where we started and where we are today ...

I guess its not a good idea then to postpone ? I have read elsewhere
that it delays the process (and I was planning to file AR-11 and change
my address once I move to CA which will involve transferring the case
from Boston to San Jose).

And may I ask - did you ever give your husband's LA address in your
petition package? We gave our MA and CA addresses since the G325A
biographic information form requires info about the employer etc ...
and since I am on an L-1 visa working here, I would have to show that I
do live here.

I am rambling ... :-)

I would print out a few, just to show that you do communicate long distance and are planning a life in the same city as soon as it's feasable. That way you'll have them just in case the Officer wants to see proof.

No...it's not a good idea. Things can get lost in the mail, your change of address might not go through...especially since you now have an interview date. If, by some chance, USCIS doesn't get notified in time that you won't be at that interview, and you don't show up for it, they will consider your case abandoned and you'll have to go through a motion to re-open. Better to keep this interview and be safe.

No, I didn't put my husband's LA address on any of his AOS paperwork. His permanent address is in Phoenix, and we were filling out the forms before he decided to stay and work in LA. We didn't know how long he'd be in LA. He's still only in LA temporarily until he can get full time work in Phoenix. But he doesn't receive any mail in LA.

We did bring proof that we visit each other and call each other alot, but the Officer never even asked where he works, so there was no need to prove anything.
