jury duty

I was called to duty once in the UK about 40 years ago. Sent home after a few hours (and I was looking forward to it). Never been called in Canada.

You can specifically opt out of being registered to vote but that still doesn't mean you won't get called for jury duty.

You must be a Canadian citizen to serve on a Canadian jury, section 3 of the Jury Act in Alberta is the relevant statute: http://www.qp.alberta.ca/documents/Acts/J03.pdf
The video also says this: http://www.albertacourts.ab.ca/Court...9/Default.aspx

Not being a lawyer, and having no desire to be, nevertheless I would ask myself if this would be grounds to appeal the verdict, by one side of the other, if this 'non-citizenship' aspect, were discovered later? Would it be a mistrial?

I've been called and served. Since I'm paid by the hour, usually more than $40/day, it irritates me intensely that where I'm working now the cradles routinely get themselves excused on the basis that service would clash with their holidays; holidays booked after they knew of the service, even though, as employees, they'd be paid to attend.

I would like to think this, if that was the case an appeal or mistrial would be possible

My husband was called up for jury service and declined due to not being a Canadian citizen (at that time). This is in Nova Scotia - He did not have to appear.
$40 a day instead of a day's pay is dire!

I would have thought they would have checked his status out with the feds first before bothering your hubbie, or is this too much to ask?
40 dollars a day, my gawd that isn't even minimum wage!

I'm just beginning to wonder if your PR acquaintance in fact spent the week in Las Vegas or similar. Perfect excuse to give the OH and other friends. Big trial going on honey, I'm sequestered in a hotel... No, I can't give any details.

I hink even if i were a mistake and I got called up as a PR and not being a citizen I'd go anyway.
More so cos I'm a nosey bugger.
How do you all think that you'd do on jury duty anyway???? I sit on the fence too much and can see everyones pov. That or take an instant dislike to some people so would call "guilty" if I thought they had shifty eyes or something.
