it may be a sharp-shinned or coopers hawk tree (don't know my trees) but a tree it is.

Its a Lappet-faced Wowhawk for sure.

As it's so difficult to see, I would suggest it's a member of the Chameleon family. I've checked Enx Ite le pedia Britannica and found this snippet.

Well, once I found it (took some doing!) it was hard to define because it's a rear-view. It's the size of a Coopers Hawk, but colouring almost looks like the Peregrin falcon that visits our backyard. If it comes back again try to get a better picture!
