Default Visa 845/846

We are considering this visa as a faster route to permanent residency. We are established business owners in the UK and will shortly be travelling to SA to look at prospective business investments (to buy the required 10% share in a qualifying business).

What is a bit unclear is the visa we need to hold prior to this. We currently hold E-Visitor visas for business purposes. Does this meet the 'substantive visa'
requirements listed in form 7 Ie "You are the holder of a temporary substantive visa - that is a visitor, student or temporary resident visa other than a special purpose, border, diplomatic, domestic worker or transit visa"

It will allow the required 9 months to be spent in SA (albeit in 3 chunks).

I am just unclear about the work element as the 845 visa requires day to day management of the Aus business. This can be done from abroad and on extended visits but is this working in the visa sense as the e-visitor is restricted!

If this visa is not allowable than we will have to apply for 163 first (we should qualify but it is a lot of extra work and expense!)

Have tried to find out on line but am still no clearer!!

Complex question ... would recommend some good professional assistance.

anyone in particular? We live near Manchester.

Is it worth asking DIAC direct? We intended to go to Immigration SA for some advice whilst we are out in OZ in March and may e-mail them beforehand, I believe they are open to this.

Considering sending application for sponsorship off to SA for 163 anyway as it is free and relatively straightforward just to get the ball rolling.

It can be frustrating as things are very detailed on the DIAC website but not always transparent!!

Incidentaly does anyone know what happens if children are dependent when you apply for a temp business visa but not by the time you apply for a permanent one (after all it can take up to 4 years) do they get to stay?

Try Alan Collett or George Lombard for advice, search forums for contact details. Or, if you want someone in Britain, Ian Harrop, http://www.ianharrop.co.uk
