Skilled Independent question
I am applying for a skilled independent visa and i only score 110 points (just five short)
However i have a brother who is on a PR visa and will be moving to Perth soon, by the time i apply he will have been there for 6 months.
Well my question is can i score any extra points (15 in total i think) under the relationship section of the points system.
He would be willing to sponser me if need be, but would he be allowed?
I have already looked at www.immi.gov.au and realise that for the family sponsered visa he needs to be there for a minimum of 2 years but under the skilled independent section there is nothing stating the time he would need to be there to enable him to sponser me. (I have heard (on the old grapevine) - that there is no set time as long as he holds a PR visa).
Can anyone help???................. PLEASE

Yes, an eligible relative who is willing to sponsor you will get you 15 points under the points system.

If he is an Australian resident (living in Australia) with a migrant visa, that should be sufficient. This is stated in Form 40, included in the skilled migration booklet package - which I would recommend that you buy if you don't already have it.
Bear in mind that depending on the category of skilled visa you are planning to apply for, you may be required to furnish an assurer. While a sponsor does not need to meet any income requirements, an assurer is required to do so. Again, more info is found in Booklet 1119 and Forms 28 and 40.

Whilst your sponsor does not have to be settled (ie 2 years in Australia), your assurer most definitely does. This person does not have to be related to you but does have to be a permanent resident or citizen, over 18 and have received a minimum amount of income for each of the last 2 years.
For those unaware if your assurer has not received enough income, DIMIA now allows 'joint' assurers to make up the minimum income level.

I think your brother will have to have been a PR for 2 years. Check in the
application forms, it's quite clear if I remember rightly.

The answer is a mix of yes and no.
Short answer: Your brother will have to live in Australia for about 2
years before being able to sponsor.
Longer answer:
For skilled sponsored (as distinct from family sponsored) there is no
specific requirement for the sponsor to have lived in Australia for 2
years. However, the Department is looking increasingly closely at
sponsorships, and will need evidence that the sponsor is capable of
meeting the obligation to support the new migrant if necessary.
HOWEVER, there is an *additional* requirement for an Assurance of
Support. This requires 2 years of tax returns to prove that the
minimum income requirement is met. The loophole is that the person
doing the 'assurance' does not have to be the same person as the
sponsor. But unless you or your brother already know other people
(with citizenship or PR) in Australia this is not likely to be much
use.
Remember, the sponsorship is not required to make a legally valid
application, but the criteria must be fulfilled at time of
application. The impact is that an application with sponsorship
problems is legally valid, so you don't get your money back and you do
wait 12+ months for an answer, which can easily be refusal.
Hiring an agent is something you should strongly consider.

As per previous comments, sponsor definitely does NOT have to be in Australia for 2 years. We have done many where the sponsor has been here for just 4-6 months. As long as they have sufficient financial capacity (not as strict a test as for the assurer) you will be okay. The issue of the assurer (who does not have to be related) is different. They do have to of earned sufficient money in Australia for the last 2 financial years.
