I would add to George's comment to say that it would be the same if the child was an Australian citizen living in the UK - British child custody laws still need to be respected.

It is very important that the visa is validated, assuming it's not subject to cancellation. If it's not validated, it will be cancelled.

Permission to take son out of country will depend on child's date of birth and who has parental responsibilty. If your child was born after 1993 and the father is named on birth certificate he has automatic parental responsibility. In this case you need to see a good family solicitor who specialises in this area. They could also help you with the violence or abuse if that's what occuring.
Please don't be embarrassed to speak to solicitor or agent. Bullies who are abusive and violent only get away with it because the other party is too embarassed or scared to do anything about it.
Hope things work out and never give up hope things happen for a reason even if we can't see it at the time

Relevant date for unmarried parents is 01 December 2003 and refers to actual registration of the birth. So, assuming he is the father, is named on the birth certificate, birth was in England or Wales and was registered on or after 01 December 2003, then he has automatic Parental Responsiblity.
